1. Introduction and purpose 

The purpose of this policy is to ensure that Tolerate Sweden AB handles personal data in accordance with the EU General Data Protection Regulation (GDPR). The policy covers all processing where personal data is handled and includes both structured and unstructured data.

The personal data that is registered and handled is used for the purpose of carrying out the work with the person or company in question that forms the basis of our business. 

 

We store the following personal data about our customers and Suppliers: 

Customers: First name, Last name, Company/organization, E-mail, Personal identity number, VAT number, Address, Postcode, City, Country, Phone number, Bank and postal giro or Bank account.

Suppliers: First name, Last name, Company/organization, E-mail, Personal identity number, VAT number, Address, Postcode, City, Country, Telephone number, Bank and postal giro or Bank account.

Orders: ip-address, e-mail, person/orgnr, VAT number, Address, Company, first name, last name, address, postal code, city, telephone number.

As a customer, you can request extract, change or deletion of this information at any time.

 

The tasks are primarily handled in these three systems that are of importance for the performance of the work. 

Specter (business system), WordPress (webshop) and Mailchimp (emailing). 

 

Parts of the personal data are also handled in other systems to perform the work. The systems or locations used can be found in 

Inventory register

 

Inactivity after 24 months automatically means anonymization or deletion of the information. This applies to all types of personal data of employees, customers, as well as suppliers. We as a company shall, as far as possible, exercise caution regarding personal data or other information. We consider it a matter of course for our partners to meet the requirements for GDPR for cooperation.

 

  1. Application and revision

The Board of Directors is responsible for ensuring that the processing of personal data complies with this policy. The policy shall be established by the Board of Directors at least once a year and updated as necessary. The administrator is responsible for maintaining the process of annual updating of the policy as a result of new and changed regulations. This policy is applicable to the company’s directors, CEO, employees and contractors affected by our business.

 

  1. Organization and responsibilities

The CEO has the overall responsibility for the content of this policy and that it is implemented and complied with by the business. The CEO may delegate responsibility and implementation to the appropriate person at the company. The CEO has delegated implementation of this policy to the Administrator. 

All employees are responsible for acting in accordance with this policy and what they want to ensure. 

 

  1. Concepts and abbreviations

Personal data: A personal data is any kind of information that can be directly or indirectly attributed to a natural person who is alive.

Registered: The person to whom a personal data relates, that is, the natural person who can be directly or indirectly identified through the personal data in a register.

Personal data processing: An action or combination of actions regarding personal data – whether or not they are carried out by automated means – such as collection, registration, organization and structuring.

 

  1. Personal data processing

Each personal data processing shall take place according to the following principles:

 

  • Legality Purpose
  • Purpose limitation
  • Information minimization 
  • Correctness
  • Data minimization
  • Integrity and confidentiality

 

– For the following treatments [e.g. email handling internally or externally, etc.], the following applies in particular. To think carefully before personal data or other sensitive information is shared with another part. Ensure a high level of safety as possible. Antivirus software, networks with encryption and computers/phones with updated programs, etc.

– The data collected shall relate solely to the purposes of the common transaction. At present, this data is considered to be. See point 1

– Registers for customers and suppliers are updated in the Specter business system. Taken out through an Export to obtain the documentation in Excel format. Specter is kept up to date according to the above stated time frames.

– Our data processing is documented on an ongoing basis in the Processing Register.

– Follow-up and evaluation of our handling of personal data must take place at least annually.

– Information to employees will take place on an ongoing basis to keep up to date with the topic.

– Any incidents concerning personal data that we process must be reported to the Administrator without delay. The administrator shall, without undue delay and no later than within 72 hours, report the incident to the Data Inspectorate and otherwise take the necessary measures in connection with the incident. 

– Our requirements that personal data is handled in accordance with GDPR must always be ensured when procuring and developing IT solutions and services, and should be part of the requirements specification and any agreements.

 

Applicability

Tolerate Sweden AB’s General Terms and Conditions of Sale and Price List apply as of the date stated on Tolerate Sweden AB’s website and replace previously sold terms and conditions of Tolerate Sweden AB. The goods presented through Tolerate Sweden AB’s website comprise Tolerate Sweden AB’s regular range.

 

Price and Payment

The prices of Tolerate Sweden AB’s website are updated in real time. VAT and shipping will be added. Prices are stated in Swedish kronor, excluding VAT. In the case of a paper invoice, a charge of SEK 19 excl. VAT will be added. Between Tolerate Sweden AB and the customer, the agreed price applies unless otherwise specifically agreed. Sales are only made to companies after a special credit check and to an invoice which is due for payment at most thirty (30) days from the invoice date. In case of unapproved credit check, advance payment can be demanded. In the event of late payment, the annual default interest on outstanding amounts is eight (18)% plus the applicable reference interest rate (formerly the discount rate) from the due date. Tolerate Sweden AB charges at any time applicable statutory reminder fee.

Our sales prices for import products that do not constitute standard stock items are based on exchange rates applicable at the date of invoice *. Upon receipt of the order, a preliminary sales price is stated, based on the exchange rate prevailing at the time of ordering. This will be adjusted on invoicing according to the prevailing exchange rate for the day.

* The exchange rate is the exchange rate that applies between the purchase currency and the sales currency.

 

Freight

Shipping is added to all orders. The basic freight is currently from SEK 99 excl. VAT, for each extra package SEK 99 excl. VAT. For goods delivered on pallets, SEK 499 will be charged excluding VAT. Information about the cost of other types of deliveries (eg bids) is provided by the seller as these prices vary depending on the delivery address. Goods cannot be picked up at Tolerate Sweden AB. In the case of partial delivery, SEK 99 will be invoiced excluding VAT per package for the listed products.
 

Delivery

Orders received before 12:00 noon on stocked products are usually dispatched on the same day, refers only to working days. Tolerate Sweden AB has the freedom to choose a carrier. It is the recipient’s responsibility to ensure reception during the carrier’s planned delivery time. Ordinary extradition usually takes place between 8-16, refers to working days.

 

Returns / Return

Returns are only approved if the wrong product or service, or for many products or services, has been delivered compared to the order placed. If so, this must be reported to Tolerate Sweden AB within a maximum of three working days from receipt, whereby Tolerate Sweden AB’s customer service leaves a return number. Returns without return number are not accepted and returned at the customer’s expense * to the customer.

Warranty

Warranty on the product are provided by the respective manufacturer, Tolerate Sweden AB makes no further warranties in addition to the one specified by the manufacturer.

Warranty for Tolerate Sweden AB’s own products amount to six (6) months. New product replaces when it advertised to the extent possible. In other cases, similar product or credit may replace. Compensation can only be paid to, approved by Tolerate Sweden AB, customers.

 

The risk of the goods

The risk of the goods moving to the buyer when the goods are delivered to the carrier.

 

Returns

Corporate customer must check all goods to verify that goods are flawless. Incoming complaint after 10 days from receipt of the customer, Tolerate Sweden AB reserves the right to determine in relation to corporate customer whether the fault should be remedied.

In the event of a complaint, the customer must contact Tolerate Sweden AB’s customer service via email info@tolerate.se. Note that obtaining the return number is not to be equated with an approved complaint. The return number is valid for corporate customers for 7 days during which time the goods must have been received by Tolerate Sweden AB. When returning the goods, the return shipping to Tolerate Sweden AB must be paid and the order part, invoice and information about the valid return number and an account of the error, preferably a detailed one, accompany the goods. If the freight is not paid or if there is no document, the goods are returned to the customer at the customer’s expense *.

Returns must be returned in original packaging and must be well packed in packaging approved by the carrier. Any transport damage resulting from defective packaging will be charged to ** customer. If the goods are not wrong and the complaint is not accepted, the goods are returned to the customer at the customer’s expense *

* Currently fr. SEK 250 excluding VAT.

** The total is settled by Tolerate Sweden AB and cannot be appealed.

 

Personal data

The data is stored for the purpose of fulfilling our commitments to the customer and for marketing purposes. You can change your information at any time by sending an email to info@tolerate.se with the username and password you have been sent via email.

 

Secrecy

The customer is not allowed to submit documents to third parties without Tolerate Sweden AB’s approval or otherwise reproduce information that is protected by law (1990: 409) on business secrets.

The customer shall, through a confidentiality connection for personnel or other appropriate measures, ensure that confidentiality is observed. The confidentiality obligation does not apply to such information that is generally known. The confidentiality obligation also applies if the agreement otherwise expires.
 

Customer accounts

Login information (user name and password) to customer accounts on Tolerate Sweden AB’s website must be handled so that they do not come to the knowledge of unauthorized persons. For customer accounts belonging to legal entities, all persons who have access to the credentials of the account are considered authorized to place orders for the legal person’s account. If you believe that any unauthorized person has access to your login details, it is your responsibility to immediately notify Tolerate Sweden AB of this and to change your login details.
  

Breach of contract and dismissal

If the customer fails to fulfill his obligations to Tolerate Sweden AB, changes the form of business, enters into liquidation, applies for or is declared bankrupt, commences proceedings on company reconstruction, initiates chord negotiations, suspends his payments or otherwise fears being insolvent or a physical or legal person who previously did not exercise controlling influence over the customer acquires such influence, Tolerate Sweden AB has the right to cancel, suspend or immediately terminate all agreements with the customer and refuse further deliveries.

 

Force Majeure

With the exception of the customer’s payment obligation, Tolerate Sweden AB, Tolerate Sweden AB’s subcontractor or the customer invokes omission to fulfill its obligations under these conditions if performance is prevented as a result of circumstances beyond their control such as labor conflict, fire, accident, war, authority decision, extensive operational disruptions this or subcontractor, acquisition difficulties or other circumstances not caused by them, which materially affect the fulfillment of the conditions and which they could not foresee or whose adverse effects he could not reasonably have eliminated. If the conditions cannot be fulfilled within a reasonable time, Tolerate Sweden AB or the customer will in writing cancel the agreement to the extent that its fulfillment is hindered by circumstance as mentioned above.

 

Disclaimer

Tolerate Sweden AB shall be free from liability if Tolerate Sweden AB has been normally careful. Tolerate Sweden AB shall not be liable to the customer for his or her loss of income or contract or for other indirect or consequential damages irrespective of whether it has arisen through negligence, breach of contract or otherwise.
  

Invalidity

Should any provision of these terms and conditions be invalid under Swedish law, this shall not affect the validity of the other parts of the condition. In the event of invalidity of the terms, the invalid provision shall be adjusted to the extent necessary for the elimination of invalidity.
 

Applicable law and dispute

Under these conditions, Swedish law shall apply.

Disputes in connection with these terms and conditions and other legal relationships that are related to the terms shall be finally settled by arbitration according to the rules of the Stockholm Chamber of Commerce’s Arbitration Institute. The arbitration proceedings shall take place in Stockholm. The arbitral tribunal shall consist of three arbitrators.

However, Tolerate Sweden AB has the right to bring proceedings against the customer in respect of payment due to these terms and conditions and in connection with this.
